Terms & Conditions
The following is the Membership Agreement between The Rocket Marketing Group ("We and Us") and the person whose name appears on the Welcome Letter ("You"). You are urged to read the terms of Membership and Membership agreement carefully and to communicate any questions that may arise to our Membership Services Team on 08448 80 91 00.
Membership Benefits: As a Club Member, you are entitled to discounts and/or other Benefits on products and services offered by participating establishments ("Benefits") as explained in the Membership Guide.
Membership Term: You have joined The Tio Pepe Midweek Dining Club for a term of 12 months. You have paid a Membership fee for this term of 12 months. As a Member, you can access all of the savings and benefits during your Membership term.
Use of Membership: Your Membership is non-transferable. You will be promptly notify us if you become aware of any unauthorised use if your Membership Card or Membership Number, or if your Membership Card is lost or stolen.
Renewal Membership: We will send you a letter reminding you of your Membership renewal 21 days prior to your annual renewal date, explaining the renewal procedure and Membership cost. Unless you notify us that you wish to terminate your Membership before your second year Membership is due to renew, a renewal payment will be taken from your original billing details. If we are unable to bill your specified billing source, you agree to provide an alternative billing source or pay us by cheque. We reserve the right to increase or decrease the enrolment fee for each Renewal Membership term effective upon renewal of your Membership.
Disclaimer of Liability: All offers promoted in your Membership Directory are offered in good faith. You agree that we are not responsible or liable for any of the Benefits provided by participating establishments and if you have any claims relating to any of these Benefits, You will only claim directly against the establishments providing the Benefit. WE MAKE NO WARRANTIES EXPRESSED OR IMPLIED, INCLUDING THE WARRANTY OF SATISFACTORY QUALITY OR FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO ANY OF THE MEMBERSHIP BENEFITS OR RELATED INFORMATION PROVIDED TO YOU. UNDER NO CIRCUMSTANCES SHALL OUR LIABILITY EXCEED YOUR CURRENT MEMBERSHIP FEE AND UNDER NO CIRCUMSTANCES SHALL WE BE LIABLE FOR YOUR INCIDENTAL OR CONSEQUENTIAL DAMAGES. We reserve the right to eliminate, add, change and substitute Benefits and participating providers without notice to you. We assume no responsibility for the payment of or contribution to any use or sales tax, which taxing authorities may impose and such taxes, to the extent, imposed, shall remain your sole responsibility or that of the provider of the Benefits, as the case may be.
Entire Agreement: This Agreement contains all of the Terms of Membership and representations, promises or agreements concerning the Membership not included in this Agreement shall not be effective or enforceable. If any of the terms of this Agreement shall become invalid or unenforceable, the remaining terms shall not be affected.
Governing Law: This Agreement and the Terms of Membership shall be governed by and construed in accordance with UK law.
Data Protection: Your personal details will be held by The Rocket Marketing Group and are used exclusively by The Rocket Marketing Group (and not passed to any third parties) for Membership administration and marketing purposes if they are deemed to be in the interest of our Members. By joining the programme you expressly consent to this, unless you notify us in writing. If purchased through the Daily Mail: Your personal details will be held by Associated Newspapers and its Group of Companies for marketing purposes if they are deemed to be in the interest of our Members. By joining the programme you expressly consent to this, unless you notify us in writing. The Rocket Marketing Group who operate and manage The Tio Pepe Midweek Dining Club on behalf of Associated Newspapers and its Group of Companies will write to you 21 days prior to your annual renewal date, explaining the renewal procedure and membership costs as outlined in ‘Renewal Membership’ above. The Tio Pepe Midweek Dining Club is offered to you in association with Associated Newspapers and its Group of Companies. When you respond to promotions, offers and competitions, The Daily Mail and other companies in the DMGT group may contact you with offers/services that may be of interest. Please give your mobile or email details if you wish to receive such offers by sms or email. We will not give your details to other companies without your permission; please let us know if you are happy for us to do so.
Cancellation of Membership: We offer a 14 day money back guarantee. To cancel your Membership, please call the Membership Services Team on 08448 80 91 00. You will be given a Cancellation Reference which you should keep safely. No refund will be given if your Membership is over 14 days. These rights are in addition to the standard policy as outlined in the Consumer Protection (Distance Selling) Regulations of 2000. Special Occasions may be excluded such as Valentines Day, Mothers Day etc. Please ask the restaurant prior to booking. Restaurants may apply their own service/extra charges. Rocket UK Ltd is not responsible or liable for any of the Membership benefits and discounts provided by participating restaurants. All bookings are subject to availability and the discretion of the restaurant manager. Rocket UK Ltd cannot be held responsible should the restaurant of your choice be fully booked or decline to accept the booking for reasons of their own. Rocket UK Ltd will not be responsible for the quality of food or service or any disputes or disagreement with any restaurant however these may arise. Any such dispute must be settled direct with the restaurant in question. Rocket UK Ltd will not be liable for any claims or disputes which may arise from your visit to the restaurant and so if applicable these should be diverted to the restaurant.
